What can I do when builder makes mistake on plat/lot fit?

I am going through the process of having a new home built by a major builder. In August, I put down a deposit and signed contracts locking in to the floor plan and lot. At the recommendation of their sales rep, I added a third garage bay as this would delay construction (preferred) and put me on a larger lot. Their promotional brochures also mentioned this was an option for the lot. I was able to select my 'dream' lot backing up to a dry pond. Last week, When the plans went to plat, the house is now three feet too wide because the sales rep admittedly assumed the garage bay would fit. Per the builder, variances and exceptions cannot be made as the other lots have already been platted. The home builder's proposed a few options: 1. Remove the third car garage bay and keep the lot 2. Choose another lot (none comparable to original selected) 3. Choose a different floor plan and redo entire option selection 4. Refund our deposits/cancel contract None of these options are acceptable.

So.......since you find no option acceptable.....unless you have one that they find acceptable, you will need to be prepared to spend a few tens of thousands of dollars on legal fees with a construction lawyer sorting it out. I would retain one immediately if thats the path you intend.
