QUESTION

What can I do when onerous NEW terms and conditions are added AFTER the contract has started?

Asked on Jan 24th, 2013 on Contracts - New York
More details to this question:
I placed my 93 year old mother in a care home six weeks ago. The care home lost her dentures on three separate occasions meaning my mother was unable to eat properly. The care home now wish me to sign an agreement saying they are not responsible for dentures, spectacles, clothing or linen OR take my mother out of the care home at the end of the month. This ultimatum is obviously unfair but I am at their mercy as my mother is old and vulnerable and has adjusted to the care home which at her age was difficult to do.

Unless you have agreed to the new terms, they do not apply. If the original contract has not terminated or been legally terminated, you should be able to continue performing under it and being paid appropriately.
