What if a contractor damaged my property?

I recently hired a contractor to remove a tree from my back yard. I was worried about the tree falling down during a storm and causing damage on injury so I decided to hire a contractor to remove the tree. The contractor's estimate stated that they guarantee their work and they are fully insured against any damage. While they were removing the tree, the contractor got his vehicle stuck in my yard and was unable to free the vehicle. It was a large heavy truck which got stuck in the mud. It was in December after a recent snow fall. Anyway, he proceeded to spin the tires and rev the engine as hard as he could, tearing up my yard and creating several very deep and unsightly tracks in my yard. I wasn't home at the time but my neighbor confronted him about the damage. The contractor was very rude and belligerent. I contacted the contractor and he is refusing to return my calls. he sends me a bill but will not return my calls to discuss the damage. Am I entitled to compensation?

Your claim may be unrelated to the guarantee, because the damage was incidental to the work being performed.  Regardless, the damage is certainly something that an insurer should look at as it ocurred because the contractor was on your property as part of the job. You should notify the contractor in writing that you want compensation and request that he submit the claim to his insurance carrier.  If you don't receive an amicable resolution, you can sue.
