I own a cottage at Lake Winola. I had a hot water heater installed last June, but was not able to use the cottage enough to check heater operation last summer due to illness. The heater thermostat does not work properly and the water temperature is extremely hot at all settings including 'pilot'. Plumber rechecked once and did nothing and now will not respond to requests to fix problem. Plumber lives in Scranton, PA.
If you want to fix the hot water problem, the best and most direct way of doing that would be to call a different plumber, not sue the prior one. I don't see any lawsuit here.
