i have asked my lawyer several times for all papers concerning our case. i asked specifically for all of the settlement facilitation agreement papers. the insurance co. came to the faciliation with 2 checks in hand then dilevered the 3'rd to our attorney a day later, when i asked my attorney for all of it he said i had it. all i had was 1 legal paper (1) stating the insurance co paid xx amount, when in fact they paid xxx amount. when i ask why only a portion of the amount is stated in the 1 legal paper i received he said because they paid by check at the facilitation. i very much doubt any insurance co is going to give xxx-amount check with no paperwork what so ever. i am going to contact another lawyer however thought maybe i could get answeres here untill then . thank-you very much
You are entitled to get copies of ALL paperwork regarding settlement, though you may have to pay for copying fees. If you are goiing to hire another lawyer you need to do so BEFORE you sign anything or make any agreements and you may have to pay the second lawyer at an hourly rate or flat fee for second opinion as it sounds like you case settled and most lawyers wont look at a case for free to reassure you so another lawyer can get paid.
