I pay monthly for a home warranty plan. I have a washer and dryer that are stacked. My washer broke this weekend. After they sent a plumber and an appliance repair person, the warranty company determined that it was not worth repairing. They are willing to buy a new washer for me, but they can not provide me with one that will stack securely with my dryer. They are saying that it is a safety risk that I will have to take, or I can pay to replace my dryer. I am curious, if they can not provide me with the the proper size unit, shouldn't they be responsible for replacing both? They offered me a cash out for the washer at about $400 less than it would cost for me to purchase the washer alone, but no other options. Can they do this?

What does your contract say? Does it provide that they must provide you with a unit that stacks securely with your dryer? Does it have a provision for what happens if an identical unit is not available? It is not a question of "shouldn't", it is a question of what the contract provides.
