Can I change my court date?

More details to this question:
I am currently on Diversion for possession of a fake ID. My diversion ends on the 9th of January and my court date for a different charge is on January 2nd. (Shoplifting, pleading not guilty). If I get charged with the shoplifting charge all of my diversion will be for nothing. Please answer with any advice. Thank you.

Call the Clerk of the Court and ask if it is possible to move the date. Many times a friendly clerk can do wonders.

Sorry, the shoplifting is already in the system and available to the court. Changing a court date will not help you.

Doubtful. The prosecutor is very aware of your circumstances and that may be why the court date has been scheduled as it is. Even if you continued the hearing date, t would be of no help because the new charge (shoplift) has already been filed and is in the system. The first court date (January 2nd) is simply the arraignment date. Very good chance you will lose your diversion.

Have your lawyer get an ACD on the shoplifting if possible. You are making bad decisions and not considering the consequences of your actions and that is your biggest problem as it will take a long time to change the way you think and act. Get a good education, study hard, work hard, get a good job, and stay out of trouble. Retain the best criminal lawyer in your area from the Avvo list.

You can continue your court date but that may not alleviate the problem. You could also fight the shoplifting. If that case is dismissed there is no violation on the diversion case. Talk with a few local attorneys in the area and see if the DAs will allow the diversion to go through in exchange for pleading to the shoplifting or if they offer some other option that you would find acceptable.

You can see if the court will adjourn the court date. However, it may not matter because they may not let you complete diversion with a pending charge. Usually, one of the terms of diversion is not to pick up any new charges. You're going to have to stop stealing stuff or else you're just going to get into more trouble and it will really effect your life.
