QUESTION

Can I get a DUI removed from my record? How?

Asked on May 15th, 2015 on Criminal Law - Michigan
More details to this question:
When I was 17, I was convicted of a DUI. That was 9 years ago, but I believe it is hampering my ability to get a job. Is there a way to get it removed from my record? I am such a different person now, I do not think it is fair for it to keep haunting me.

You can apply to the court, but it's not likely. It should not interfere with future ploy menu, unless you will need a commercial DL.

In Missouri, you can hire an attorney to file a petition in court to remove the record of your first DUI as long as 10 years have passed since the original DUI and you have not had any alcohol-related law enforcement contacts (arrest, charge, conviction) during those 10 years.

Fair is not the question. Generally drinking and driving violations continue to appear upon your driving record for a period of 10 years, therefore yours will disappear relatively shortly from the driving record. Removal of drinking and driving violations from your permanent record is for all practical intents impossible. My best recommendation is that if you are having difficulty and believed that portion of your record is preventing your being hired you'll have to address it upfront, with an explanation, in order to minimize the damages it is continuing to cause you.
