back in 2009 I was arrested and charged with driving while license invalid and possession of marijuana over 2 grams under 2 ounces. when I was at court, the officer told me to just sign a paper for time served and get out of there. I had no fine and got time served. Now that I am trying to get jobs, I find out that it is on my record as a conviction. Apparently when I signed that piece of paper I plead guilty and signed my rights away. I am not eligible for expungement and I was not offered a plea or any type of probation. I want to know am I eligible for a seal at least? I was not informed of the severity of signing that paper and I am furious. How can I get it off of my record? I am in Texas and am 25 if this makes any difference.
A final conviction cannot be non-disclosed. The remedies possible are a pardon or a habeas corpus writ to set aside the plea. These are difficult procedures to go through but may be worth considering. Consult an attorney familiar with post conviction relief to discuss the costs and issues involved.
