Can the state bring trafficking charges against me?
Asked on Apr 03rd, 2013 on Criminal Law - Colorado
More details to this question:
I was arrested and so was my boyfriend. Being a felon, I got charged with weapon charge. The gun was in the glove compartment in my car. My boyfriend got charged with trafficking. My case was dismissed, no action.
The case can attempt to charge you with anything it chooses, the question is if it can prove the charges. Get and attorney and do not speak with the authorities, or anyone else until you have received counsel.
I would need to know more about the circumstances of the case, but given the scenario you described, the State could theoretically charge you with conspiracy or aiding and abetting. Contact a criminal defense attorney so he/she can ask questions and get more information for a more solid opinion.
could happen, but less likely at this point - usually they add the charge before they dismiss the other charge I would be interested in working on either case.
