QUESTION

Do I get served a protective order in nyc?

Asked on May 09th, 2012 on Criminal Law - New York
More details to this question:
My boyfriends kids' mother claims she has a protective order on me based on nothing. For her and her child. I never seem this woman before but we have spoke on one occasion. It was a nice talk but somehow things went south, which allowed me to find out she doesnt want anyone with her kids' father and she said she wants him to be miserable . So im trying to understand how its possible for me to have an order if i never seen or did anything to this woman. Im currently living with my boyfriend so her having an order out for they're child makes our living situation complicated. Plus i dont want to have such things on my record. I've never been in trouble n i dont want to start now. What can i do??

An order of protection must be formally served on you and usually only after criminal charges are filed.
