Do I have to do jail time for a DWI?

More details to this question:
If someone pled guilty to DWI/DUI in Washtenaw County Michigan, sentenced to weekend jail, also sentenced to a program for reduction of jail time. If program is completed does the individual still have to do jail time?

Typically not. You will likely get jail credit for the time served on the weekend jail credit, and if your are given credit or a time reduction, then you will only be responsible for the remaining balance of jail left after all credit is given.

Without reviewing the court file and seeing the exact details of the plea agreement and the sentencing order it is impossible for me to answer your question. You should contact the criminal division clerk of the court where the plea was made to answer the question you are asking because they would have the file and should be able to answer your question.

Your program is to REDUCE your jail time. What do you think that means? If/when you finish the program . . . you may be able to go free OR . . . YES you may have to FINISH out the non-reduced portion of your jail sentence.

I think your question answers itself. If they are sentenced to do jail, then jail they will do. If they can avoid jail, then that is a possibility. They can always go back to jail if they violate probation, so that is a sepaarte issue.

I really need more information to answer your question. I am not familiiar with Washtenaw County as I practice law in the Upper Peninisula and every county is a litte bit different.
