My boyfriend recently went to jail due to a warrant for assault on a family member-strangulation but he 1) paid to have his warrants taken off. 2) the victim is currently in jail for a methamphetamine case 3) we where stopped for no insurance but when we showed the police our insurance card they automatically turned to talking about his warrants in which he shouldn't of even had in the first place.
A traffic stop must be legal, or any of the evidence discovered after the stop can be suppressed as the fruit of an illegal search / seizure.
He should hire an attorney on the assault family violence -impeding breath (strangulation) case. District Attorney offices prosecute these aggressively and just because the victim is a drug addict or in jail does not mean they will dismiss his case.
