How can I expunge a first time shoplifting charge?

I was caught shoplifting items for $69.99. I am 20 years old.

Go to the clerk's office in the court where the conviction occurred and they will give you the necessary forms to request it.

If you have not yet pled guilty on this, then get a lawyer to defend you. They may be able to work out something where you end up with no record. otherwise if you pled already then you may have to wait 5 years from the date of sentencing in order to expunge it under Michigan law.

If you have completed the terms of your sentence, you can obtain the form from the court clerk to petition the court to expunge your record.

You need to wait until you have successfully completed probation. Then contact an attorney about filing the petition.

There is a legal procedure for expungement of an arrest or conviction, even for felonies. You must first resolve the charge by a plea of guilty or an acquittal. Your case is a misdemeanor. In some cases you can obtain forms for this at the criminal clerk's office at the place you were arrested, and proceed with the process on your own. You will have to pay costs. the clerks office will tell you the cost in advance, and, in most cases, how to proceed with the entire process.

Expungement is covered in California Penal Code Section 1203.3. In any case, in which probation was granted, whether misdemeanor, Wobbler, or felony a petition for Expungement can be submitted to the court. The person seeking Expungement must not be (a) serving a sentence of any offense, (b) on probation for any offense, or (c) charged with the commission of any offense.

If you have already pleaded guilty and been convicted of shoplifting, you can not get the conviction expunged, sealed, or removed. If you have _not_ already pleaded guilty, then hire a criminal defense attorney to handle the shoplifting charge. Depending on which court this is in and whether you have prior convictions on your record for shoplifting, your attorney can possibly get the charge reduced to "Littering" with just a fine and no court appearance.
