QUESTION

How can I get rid of a warrant?

Asked on Oct 12th, 2012 on Criminal Law - Michigan
More details to this question:
I was told that I was going to be sent out a letter to return to court for a ticket I received about a year and a half ago. I never received a letter to my address. Every time I appeared in court before this, they always give me another date or the officer doesn't show up. I need help because I canโ€™t get arrested because I have a son that needs me and it wasn't my fault that I didn't receive a letter.

If you have appeared in court the warrant would have been withdrawn. You should retain a lawyer to get the best possible disposition if you can afford it.

Hire an attorney to lift the warrant for you and get the ticket reduced to a non-moving, no-point infraction. Or pay the bond and they will lift the warrant and give you a new court date.

You need to hire a lawyer to go to court. A lawyer can recall the warrant without you being present. That's a lot better than you showing up by yourself and getting taken into custody for the warrant.

You can only cancel the warrant by making a court appearance. Contact the court clerk to set-up the hearing date.

Get an attorney on your side now. You were not given proper notice, and the court file might even indicate that.

Go to the Court and get the warrant brought into the Judge. Explain what happened and he/she will probably recall the warrant and deal with the offense.

Get a lawyer and fight the matter. If the case has been hanging fire in court for over a year. The attorney may be able to get it dismissed.

You will have to contact the court, make your excuse, and seek another date. Generally the will set it and lift the warrant under the circumstances. I would not make the excuse of never received the mail unless you examine the court file and find it was misaddressed.
