How can I negotiate an open container citation?

More details to this question:
Is an attorney necessary to negotiate down an open container citation with the city attorney? Offender is 17 with no prior court contact.

It helps to have an attorney to negotiate the matter since that is what they are trained to do.

No, an attorney is not "required" but having a lawyer is highly advisable. I've been practicing 16 years and each year I handle criminal cases, I get better-and-better and my career. How to negotiate is an art, not a science. There is no way to tell you how to negotiate. An open intox ticket is a criminal offense and you should not be penny wise and pound foolish. Hire a lawyer.

I'd recommend you retain an attorney to assist you with this matter. While you always have the right to represent yourself, your interests may be better served by bringing in a licensed, experienced professional to assist you with this matter.

Although not necessary, it may be best to have an attorney represent him. You may make an agreement and not be told all of the consequences of the plea until it is too late. After all, there is no requirement to do so by the prosecutor or the police, whether intentional or unintentional, since they do not represent you.

You don't need an attorney to enter into plea negotiations with the city attorney. However, the city attorney does not have to agree to a plea with either you or an attorney.

An attorney is not required and the prosecutor will probably offer you the same deal with or without an attorney, but the difference is an experienced criminal attorney will know whether the deal is good or not. An attorney will also be able to evaluate your case for any errors that could possibly reduce the charges or get them dismissed. I would suggest at least have an attorney evaluate your case first before you agree to anything. A lot of defendants find the cost of retaining an attorney worth it if for nothing else to relieve the stress and tension of having to represent themselves in an arena that they have no experience in.
