QUESTION

How do I avoid jail time for theft?

Asked on Nov 21st, 2012 on Criminal Law - Michigan
More details to this question:
I was caught stealing from a store and I went to court and got probation and a fine and community service. But I was at this pizza place and saw an iphone on one of the counters and grabbed it and the pizza place employees called the police and the sighted me. I donโ€™t want to go to jail and I know what I did was wrong and Iโ€™m never ever going to do anything like that ever again! I am only 18 and I need legal advice or help.

Some young people are bad decision makers and do not realize that if they get arrested and convicted they will have a criminal record for the rest of their lives and it will be very hard to get a decent job. A theft of a few dollar item can cost you a lot more than you think and it is time to grow up and be an honest, decent person who works hard, studies hard, and makes a success of himself. That is better than being a thief or a criminal I can promise you that. You will not go to jail, but you might be probation and a criminal record, which is much worse than jail.

You better hire an attorney ASAP before you make a wrong move, like open your mouth to the wrong folks and incriminate yourself. Petty theft with a prior can be charged as a felony. Any wrong move you make from now on could be the regret of your life!

Update Your Profile
Hire an experienced criminal defense attorney. You are looking at a probation violation and new charges with a prior. Jail time is a good possibility.

Not only will you face the new charges, but you will likely be re-sentenced for your initial theft since one of the provisions were no further criminal activity.

You may be charged with a new crime as well as a probation violation on the original charge. Either matter may give the Judge the opportunity to give a jail sentence. You should hire an attorney to properly represent you and make sure the cases are resolved to the best outcome.

That will depend on the judge but the court may give you some time in order to teach you to keep your hands to yourself.
