QUESTION

How do I get back police bail?

Asked on Dec 12th, 2012 on Criminal Law - New Jersey
More details to this question:
I was given a desk appearance ticket in December 2011 and the police department set the bail at $50. My attorney came and bailed me out and I paid him back later that week. Anyway, the case was dismissed in my favor on July 27th 2012. I haven't received the bail money back. I did some research and found out that this was considered "police bail" and should have been released after I appeared for my first court appearance, which was many months ago. It's not a lot of money but I just don't understand where the money went or how to get this back. This was my first and hopefully only encounter with the law, so I have no idea about any of this. Any help would be appreciated. Thank you.

If you were arrested in Connecticut, any cash bail that was posted would be under the control of the court where your case was heard and dismissed. The court will only refund that cash bail to the person named in the bail receipt, upon presentation of the receipt to the clerk's office with ID. If your attorney posted the cash bail, he should have the receipt and be able to retrieve the money for you. If he had the police put your name on the receipt, then he could turn the receipt over to you and you could retrieve it.

Your attorney should have the bail paperwork and can get the money back with a request.
