Last night my husband was drunk and the arresting officer said he was a danger to himself. While on the ground the officer said he was kicked and arrested my husband for assault on an officer. My husband has a good job, no history of violence and no priors except a reckless driving misdemeanor from years ago. Is there anyway he could plead to something and not have a felony? We are both very worried but what's next.
Enter a plea of non guilty. Ask for an attorney to be appointed if you can't afford one. That attorney will try to strike a deal. A good start would be get one charge dismissed (probably the assault would be most agreeable to the Prosecutor) and plead to the other with a deferred sentence.
