QUESTION

How far would someone have to dig to find my record?

Asked on Oct 02nd, 2013 on Criminal Law - Michigan
More details to this question:
Back in 1992, I made a stupid mistake and tried to steal some goods from a store, Retail fraud, first and only time. I was given probation but ended up serving time in the honor camp in Kent County Michigan. Since then, I have had someone check my ICHAT, but it came up with nothing. I was advised not to place it on my applications due to most employers I guess use ICHAT for background checks.

Go to the court and try to get the matter expunged. If it is your only conviction ever then you are eligible.

It depends on the quality of the background check they use, but if it does not show up on IChat that is probably a good sign. Were you granted a diversion or some other delayed sentencing option that would keep the matter of your public record? If it is on your record, it is usually better to own up and be honest about it to a potential employer who may hold it against you that you did not tell them about it. Since it has been more than 20 years since the conviction, you can use that as a good argument in your favor that it was a one time occurrence and you have been successfully rehabilitated. Most employers will not care about a conviction that old, unless it is a felony or a serious crime.

If no new contacts with criminal justice system since then, you should put your mind at ease and hire an atty to expunge your record otherwise you are lying on application and most employers consider that grounds for termination even when found years later.

This isn't legal advice it is practical. If you are not going to get the job if you list it and you will get the job if you don't but may lose your job down the road if they find out, why should you list it?

I do not know why it wouldn't show up are you sure you didn't have a diversion program whereby the underlying charge was dismissed and made non-public when you completed the program?
