QUESTION

How much time is my boyfriend looking at for this case?

Asked on Nov 10th, 2012 on Criminal Law - Florida
More details to this question:
A year ago my Boyfriend's uncle and two of his friends broke into a house and stole four shot guns, my boyfriend's uncle came to our house and asked my Boyfriend if he could leave some shot guns there and he would pick them up tomorrow, well he never came back for them and US Marshals came into my house and found the guns and took my boyfriend. My mother and I called the owners of the guns and explained everything to them so they told us they know my boyfriend did not steal them and they wanted to go downtown with us to sign a statement saying that my boyfriend had nothing to do with the burglary and Break in. Well here we are a year later and the Marshals come to my house again and take my boyfriend saying he's been charged with engaging in a criminal activity, burglary of habitation, and theft of four fire arms! We told them that we already had taken care of this a year ago and the owners of the guns even signed a statement saying they knew my boyfriend had nothing to do with the burglary. So they took my boyfriend in so I called the investigator that we spoke to a year ago and I asked him why my boyfriend is being charged with all of these charges and has a bond of 65,000. He told me that he knows my boyfriend had nothing to do with the burglary but was involved with this crime simply because he held on to the guns. Can somebody please give me any kind of information on this and how much time he could be looking at?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. At the very least your boyfriend may be charged with receiving stolen property. His possible sentence would also depend on whether he is being charged in State or Federal Court as the sentencing guidelines in Federal Court are usually harsher than in State Court. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your boyfriend's arrest. He/she would then be in a better position to analyze his case and advise you of your options. F

He might be looking at 30 years in prison. If you think he does not need an attorney on this, you are mistaken. Only a privately retained criminal defense attorney will do.
