Hi, when I was 13 years old I got caught shoplifting an item of under $10. Police came, I didn’t get arrest and called my parents to picked me up. I didn’t go court or have no court date. Later….received a letter Your chid was referred to attend the Retail Fraud Education Program. If your child is not presently on Probation, but was referred due to a shoplifting incident, your child can avoid formal court action if they successfully complete this class. Otherwise, you and your child will have to appear in Court. It was a 2 day class and fee of $100 and i finished it. On the i129f. Have I ever convicted a crime? Should I say no ?
If you're the US Citizen, it's not going to make a difference. The only criminal conviction that would disqualify you from sponsoring your fiancé would be crimes under the Adam Walsh Act. These crimes involve sex crimes against minors. Even if you were convicted of murder you could still sponsor your fiancé. That being said, you should explain the circumstances in the attachment page of the 129f so you fully disclose it.
