QUESTION

If my attorney said I should expect probation, how likely is he correct?

More details to this question:
I have a pending felony possession weapon of mass destruction for a sawn off shotgun that was locked up in my home. I am a first time offender. I have a child and asked him what to expect so I could prepare if I had to go to jail.

A shotgun is not a weapon of mass destruction in New York, I do not know where you are or what the facts of your case are. It depends on what judge you get and if there is a mandatory minimum sentence. If no one got hurt and you had a gun at your home the judge probably would give you probation unless you intended to kill a large group of people.

In this forum is unwise, and in fact impossible, to second-guess your attorney. If you don't trust your attorneys advice I would suggest that you get a different one, in the meantime if you are satisfied with his performance take his advice and hope he is correct.
