My home was recently raided early Friday morning by the constable's office. It is not that I minded a search warrant but the way it was carried out. The was a brief banging on the back door immediately followed by my door being kicked open destroying the door frame.. We had no opportunity to get out of bed to answer the door and when I walked into my family room I had over 6 men armed with M16 rifles with lights pointed in my face. They demanded my wife and I hold our hands over our head for about 15 minutes with guns pointed menacingly in our faces constantly yelling for us to keep our hands up. We were finally being told that they had a search warrant which they did not show and we were initially not allowed to see. I was taken out of the house and was told to sit with an investigator and a homeland security person and told the purpose of the warrant was a search for child pornography. The officers which were from Precinct 4, Homeland Security, Secret Service and ICE.
You may have a cause of action against the government but this is a very difficult type of litigation to pursue. If there was a search warrant the problem is made more difficult. It may be worth you making an appointment with an attorney close to you. I am in Dallas and would be interested in looking at it if you are here. It is possible that you may have to pay some or all the costs of any litigation so be propared.
