More details to this question:
My husband has been arrested for a simple assault charges in Michigan but we live in Florida. We are snow birds. If he gets put on probation for this crime, can we go back home to Florida and do his probation down in Florida?
It can be done if the court and probation departments in MI and FL agree. He can also do probation reports by mail from FL. Make sure he gets permission from court to leave state while on bond and/or probation. otherwise can't legally leave MI.
Yes, it is possible. It takes cooperation from both probation departments, though. You may be back in Michigan by the time the Court sentences him though.
It is possible and it does happen. Make sure the judge is aware of this before sentencing you or placing you on probation so arrangements can be made to transfer your probation to Florida. Usually there is no problem with this as long as neither party objects. They can also keep you on probation in Michigan and still allow you to live in Florida as a special condition of your probation. Sometimes they will do that and have you report by phone.
