QUESTION

Is there a chance that my husband gets another trial?

Asked on Apr 09th, 2012 on Criminal Law - Texas
More details to this question:
My husband was convicted of a capital crime and his attorney did a very very poor job. He was court appointed. So he filed the appeal but I didnยดt know we could also file for a new trial and the 90 days are up already. Is there a chance he can get another trial after the judges review his case in appeals?

Even after the appeal there is a possibility of having the case reviewed on habeas corpus. If he was sentenced to death, he gets an appointed attorney. If sentenced to life, he would have to hire a lawyer.

Yes but you need to hire a good post conviction attorney to file an appeal or writ. You get what you pay for so hire the best you can afford
