QUESTION

Misdemeanor/ Warrant

Asked on Mar 28th, 2012 on Criminal Law - Texas
More details to this question:
I have a Class Misdemeanor that I have gotten arrested for 03/28/2011. I paid a bond and got a lawyer. I found out today that my lawyer didn't go to the last setting on January 26th and that there is a warrant out for my arrest since February. Since my lawyer doesn't get in touch with me I don't know what to do in this case. I definitely can't go to jail since I got a three month old baby at home. But what other options are there once the setting was missed, can my lawyer set a new date or will I have to come up with the money for fees to take care of his mess up?

You need to call him and he needs to clean up his own screw up. That is malpractice and you should report him to the State Bar if he doesn't clean it up. Any real lawyer will clean it up. If he doesn't, file a grievance and hire a new lawyer to keep you out of jail. Just remember, you get what you pay for.

What can be done depends on the county. Generally your bond isn't forfeited because your lawyer does not show up for court but because YOU do not show up for court. You can always make a new bond. And, you can hire a new lawyer.
