Should I accept state time, if I was not even indicted?

More details to this question:
It has been over six months and I have not been indicted on my drug charge in New York. Now, my lawyer said that the district attorney is offering state prison time or go to trial. They also said that they would indict me if I do not accept the jail time. Can they blackmail me like that if there is no indictment? Please help.

No one can help you on this forum either follow the advice of your lawyer (and by that I mean pick your poison, not take the time), or retain other counsel if you do not trust that attorney.
