What are my options for fighting a DUI case?

More details to this question:
Couple days ago, I got arrested for DUI.I took the breathalyzing test twice, and blew 0.07 and 0.08. How much does it cost to get a lawyer to fight this? What are the odds of winning the case with a lawyer? Thank You.

Retain a good lawyer to handle the case. You will most likely plead to a violation or get convicted at trial of a violation and lose your license for 90 days and pay a fine. That is not a very high BAC but enough to get convicted at trial since only a very low scare has a chance of being found not guilty of any offense with a DWI or DUI case.

Prices vary depending on the area in which you live, if it is a misdemeanor or felony DUI, and the quality of the attorney. You will absolutely do better with an attorney than without one.

Your options: (1) plead guilty, (2) cut a deal, (3) go to trial. Without knowing the facts of your case, any advice about your "odds of winning" would be pure speculation. .08 is the legal limit;; however understand that the DUI statute states that someone is under the influence of alcohol if their breath test is .08 or above, OR their ability to drive has been affected to an appreciable degree by their consumption of alcohol. This means that you could blow under a .08, but still be found guilty of DUI. Only way to know how best to handle your case is to review the case file. DUI cases are expensive, especially if the case goes to trial, but then again, a DUI conviction is even more expensive and can have very long term consequences. Hire an attorney.

The cost is whatever the attorney that you hire wants to charge. As to the odds of beating this case. That depends on all the facts in the matter.

With such a low Blood Alcohol Content, you have options to avoid getting a DUI. Your lawyer will need to scrutinize video of the Breathalyzer administration (if there is one), and review the Breathalyzer maintenance logs, to ensure the machine was properly maintained. If there is video of how you performed on the "Field Sobriety Tests", and why the police stopped you in the first place, that should be reviewed as well. Most good DUI lawyers would charge anywhere from $1,500.00 to $5,000.00 to open the case.
