My girlfriend and I live with my family and her parents never see her. That’s because they are all abusive verbally and previously physically. They just stress everyone out including myself. They filed 2 false reports (ex parte order for involuntary examination) and she was arrested and brought to be baker acted. The order states she is starving herself and is depressed and has mental issues, etc. but she doesn't at all. She did lose a little weight but that's due to getting off of birth control shots which everyone knows they affect ones weight. They made it clear they are going to keep doing it. They don't care for or about her and don't help her in any way. Now, she is stuck there for her second day to be checked out by doctors. The room she is in is like a jail cell just not as bad, but still bad and could make anyone depress for the time being there. I am scared she may be stuck there because they filed false reports. What can I do? Can we sue them? What stops them from doing it again? They are the ones that need baker acted. Her father is abusive alcoholic with serious problems considering he got his child killed and puts all of his anger out on his two cats and children. She is 21. An adult who takes care of herself and does not need the stress from her abusive family. We don't even want to ever see them again.
Really, the only thing that I can do for you is to tell you that you need to get an attorney for her. I have handled this type of case before, and it is usually very expensive to hire a private attorney.
