You should retain a good criminal lawyer since you are now facing a possible jail term. If your prior was a felony and you plead to a felony you will get a prison term in most jurisdictions.

They do not have to arrest you to indict you. They can do it the other way around if they have the evidence.

There is no requirement that you be first arrested. You need to hire a lawyer pal.

What you are facing will depend on what your sentencing guidelines are based upon what you will eventually plead to or be convicted of. If you consult with an attorney and go over your complete record they should be able to come up with a more specific response. Charges can be filed against you without being arrested and if often happens.

You do not have to first be arrested before you are charged with a crime. Police will do their investigation and may request a warrant for your arrest based on the evidence they have.
