What happens when caught smoking marijuana?

More details to this question:
I got caught smoking and the cop didn't write me a ticket on the spot. He told me my violations and said he would contact me and let me know my court date.

Well you want to get an attorney. If you do not have any prior cases then maybe he can get you a deal so the matter goes away if you do what the court tells you to do. You need an attorney.

If the police file a report with the prosecutor, it will be up to the prosecutor whether any charges are filed.

You are a bit skimpy on the facts. Did the police confiscate the marijuana? Were you arrested and booked? Best thing to do is hope you are never contacted, which is very unlikely, and while you are awaiting notification save up for your attorney's retainer.

They can do that. It may be a local ordinance, or a state case where they get the warrant issued later. Just wait to hear from them.
