If you need specific legal advice for your particular circumstances, I encourage you to privately consult with a lawyer. If you are charged with an offense and cannot afford to pay for your own defense, the court may appoint you an attorney payable at the public's expense. You have a right to counsel. Any probation issues and possible sanctions would depend on what you are on probation for. The sanctions may vary significantly depending on the charge, court, and county. Chances are good that you may be charged with a probation violation since simply being arrested, consuming alcohol, or prohibitions against police contact are common terms of probation. However, your probation officer may wait until your DUI case is adjudicated before they act. If you plead guilty in the OUI case, that would be a potential probation violation as well.

The penalties for a first OWI are 93 days in jail, a fine of $100 to $500, suspension of your license for 30 days, and restricted license for 180 days, and 6 points. You would also be facing a violation of your probation. and your probation could be revoked.

You did not mention what offense you may be on probation for. If another DWLS, then you could have two problems. In some Courts, the second DWLS could result in probation, while others could result in jail time. If charged with a Probation Violation, you could face jail time in that case for a the probation violation. You should hire an attorney who works in your courts to tell you what to expect from your particular judge. I hope that this was helpful.

Your probation can and likely will be violated and you can be punished on the underlying crime. DWLS is punishable up to 93 days and jail and a $500 fine plus costs and driver responsibility fees for the next two years and an additional suspension.
