What rights do I have if someone should press charges for assault?

More details to this question:
Today I was racially assaulted by an individual in my neighborhood and after being assaulted several times I smacked her in the face. The policeman took a statement from her and her witnesses. However, one was never asked of me. What rights do I have if she should press charges for assault?

You are innocent until proven guilty. Anyone can make a charge but it has to be proven. From your information, you should not be charged. If you are, I expect the charges will be dropped.

The first thing you should do is retain the services of an attorney. If you have witnesses, you need to obtain their contact information. You can request that the Detective assigned to the case or the responding office supplement his/her report to include your version of the facts and the names, addresses and phone numbers of your witnesses. Of course, you should consult with an attorney beforehand to be sure that neither you nor your witnesses make any statements that would be harmful to you.
