Resisting arrest is when an individual delays or obstructs a peace officer who is acting within their legal capacity. In this case, it seems as if there is enough to charge your brother with resisting arrest. However, based on the information you provided, your brother may have a defense based on the fact that he did not willingly or intentional delay the peace officer. As in the evading, the fact that your brother did not pull over for several minutes meets the elements of evading. He may have explanation to the charge which would act as a defense when the case is negotiated or fought. As the false name or information to the police officer, again, it seems like a valid charge, however, there may be defenses to this charge.
