More details to this question:
I was arrested at the hospital. I drove myself there after a hit and run accident. When I got to the hospital, they asked had I called the cops yet I said no. They took me right back because two weeks prior, I had slipped disk in my back. After the hit and run, it hurt in same spot all over again. When I come out of x-rays, the cops were out there and they proceeded to ask me what happened. I told them I was driving down rt4 in pouring rain. I couldn't see much. I could definitely tell it was a Chevy style truck that tapped me in the rear. I wasn't sure if I had hit person in front but they never stopped. The person who hit me in rear backed up some and made a right where there was no way possible for me to go that way. The cop said to hold on. His partners and he went outside and looked at car for maybe three minutes. Then he came back saying that I was never hit. He has it all on traffic camera so I asked what it was then. He had no answer except to tell me I’m lying. He then he pulls me out of my hospital bed, arrested me, took me down the hall a bit then went over to doctor. The doctor gave him my medical records without my consent. We go out to the police car, I asked what am I being charged with and he says false police statement for trying to get Klonopin 2mg by fraud which I have prescription for and trying to get Percocet by fraud. Now back to when I first got to the hospital, the doctors always ask how much pain am I in. I said about a 6-7 but I don’t take Percocet. I can only use muscle relaxer or something without opiate because at time of this I was taking Suboxone. Anyway, the cop was like "yeah I know you don't take them but you sell them. That’s why you have a PO box right?" I pretty much know where this was going a loose for me. I said no more and they told me no more. This happened on 05/01/2012. I don't hear about what’s going on.
Do not say anything more to the police without an attorney present. If confronted by the police or arrested say that you want an attorney and that you will not say anything without your attorney present. Consult an attorney IMMEDIATELY to protect your rights.
Hire a lawyer before you open your mouth to the wrong folks and begin incriminating yourself. A lawyer should be the only person you speak to, because anyone else can be used as a witness against you, including your best friend.
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.
