QUESTION

What should I do if my ex is taking my things?

Asked on Dec 28th, 2012 on Criminal Law - Florida
More details to this question:
My ex broke into my home. Drove 7 hours to do it. Was seen by three independent witnesses. Hanging around for the last month. He said I invited him here (untrue). We have been divorced since September 12. It has gone to the DA for review. I have told everyone for the last 8 months not to divulge my location. I have had no contact with him for 8 months and there is no paperwork to say he could take my things. He has never been invited to my home. He has threatened to come back and kill me. What should I do?

If the D.A. is reviewing the original incident, you can contact them or the police to find out what the status is. With regards to his threats, I suggest you file another police report and tell the police what happened.

Go talk to the DA about the matter and let that person know that you are serious about this person being prosecuted. If he ends up in the court system then the court can make him obey or sit in jail.

It sounds like you have already filed a police report. It will be up to the prosecuting attorney as to whether any criminal charges will be authorized. You could, through the court seek civil damages for the property that he wrongfully took.
