QUESTION

What was the statue on DUI?

Asked on Mar 27th, 2012 on Criminal Law - Texas
More details to this question:
In '04 arrest was made for DUI. I spent the night in jail, released on bond. Driver's license was suspended for 9 months. Paid $125 reinstatement fee to TXDPS when renewing. Nothing showing on driving record. Nothing brought up on this til 09 and attorney made contact. No response and now 3 yrs later they are trying to do something. Isn't this to old to deal with?

You have not provided enough information to even understand what is happening with regard to your license situation. If you paid a reinstatement fee and TXDPS accepted it, then you should not be facing any kind of suspension now unless there are more facts that are not disclosed.

Very odd. Statute is 2 years, but did they exercise due diligence in finding you. Sounds like a winnable case. Hire the best DWI attorney you can afford.
