QUESTION

What will be the charged as a misdemeanor?

More details to this question:
My mom is getting charged with Child Cruilty, she has never been in trouble with the law. The guns that she owned were not in locked up from my 11 year old sister and she was at school at the time. Why this happened was because my dad had marijuana and someone sawed it I'm guessing, he was not selling it, he works for a company, which he has a medical card. (That is another story) My moms hearing is tomorrow morning and her attorney were an email to her and she called me quick this more to tell me she would basically be charged the same as my dad. That they both need to take the same deal. My question am I guessing, wouldn't this be a misdemeanor seeing it never physically hurt my sister and/or could this be dropped at all?

Yes I think it should be a misdemeanor. Looks like the DA wants a package deal dragging your Mon down with your Dad. The charge should be child endangerment not child cruelty.

I cannot guess. But the way to tell is by seeing what your father is charged with. Tell your mother not to give the police any statements and get a private lawyer or a Public Defender.
