A lady who is addicted to methamphetamine had a baby. The baby passed away and was no more than two months old. The lady and her infant son took a nap in her bed. The lady wakes up to find her son lifeless she said she immediatly knew he was dead because his body was already showing signs of a deceased infant. She calls her mother first. Her mother called 911 sent them to her home. The cause of death was unexplained infant death SIDS. The otopsy revealed that the baby had both methamphetamine and amphetamine in his system. She was alone and the father did not live with her they were not a couple. The father had not seen the child in one week. She is charged with ABANDON ENDANGER CHILD CRIMINAL NEGLIGENCE STATE JAIL FELONY STATUTE 22.041(C) ARRESTED BONDED OUT. THE GRAND JURY HEARING INDITED ON THAT CHARGED AND ADDED THE CHARGE INJURY CHILF/ELDERLY/DISABLE W/INT SBI/MENTAL FIRST DEGREE FELONY STATUTE 22.04(E) This is in the state of Texas In such a case I would like your professional opinion her sentence will be if convicted? Is this something that she could get off with probation only? First time in trouble with the law or in your opinion what are the chances that she will actually be sentenced to serve jail time. I know that you can not say what a judge would see fit to punish her for this. I simly would like to know your opinion will she do jail time and if you think she will if convicted how long? She has not been to court for these charges yet. On her first appearence the da offered her 5 years confinement in prison. She did not accept filed paper work for court appointed attourny. 8/7/2012 there was an Announcement. 8/7/2012 the event held was a Waiver. The comment listed was "OF NOTICE". The next event will be on 9/14/2012 another Announcement. This information is public and i got it from the collin county website by looking her name up under the court case look up option.
