QUESTION

Will D.A. drop assault charges before trial?

Asked on Nov 07th, 2013 on Criminal Law - Michigan
More details to this question:
My stepdaughter stormed in our house and attacked my two daughters without warning. After repeatedly telling her to leave and to stop ,my wife grabbed her and held her down until the girls could get away. They took out assault charges and I tried to take out unlawful entry charges but the magistrate wouldn't allow it. Now she has filed false charges against us and we were arrested, fingerprinted and photographed. She is on disability and so am I. My wife has also been removed from work because of pain from fibromyalgia and neck surgery. Is there any way we can get these charges dropped and expunged without an attorney?

Why on earth would the DA drop charges? You need to hire a lawyer for her before she gets duped into a plea she will regret.

It is hard to say if charges will be dropped. Discuss with your public defender or private lawyer about the facts and they may be able to convince the DA that you were a victim and not an assailant.

The court system and criminal procedure are very difficult avenues to navigate without experienced help. As much as you would like to proceed without an attorney or believe you cannot afford one, it is very difficult, if not impossible, to successfully defend yourself without someone who is trained and experienced in doing so. If you cannot afford an attorney, the court would probably appoint you one. It sounds like you may have a valid defense and it would be in your best interest to have an experienced criminal defense attorney from your area representing you and your interests. Only the prosecutor can decide to dismiss a case. There may be issues with your case that can be used as leverage when negotiating with the prosecutor which is another reason why having experienced criminal attorney represent you is very valuable.
