QUESTION

Will I be able to go on vacation if I complete my deferred sentence?

Asked on Oct 25th, 2011 on Criminal Law - Michigan
More details to this question:
After I complete my deferred sentence, under MCL 771.1 and there is no conviction on my record, will I be able to enter Canada, or does Canada constitute this as a conviction because I plead guilty? I realize there will be an arrest record, but will this bar me from entering for vacation. What can I do?

Should not be a problem. Canada should just look at the case as a dismissal which is what will officially show on your record.

The case would be dismissed so there would be no conviction. After 5 years you could ask the court to expunge the record which would remove it from the public record.

You can check with the Canadian authorities, but I don't think having a conviction on your record is going to prevent you from entering the country.

If everything is perfect, then you should have no problems. However, there can be delays. Since your record reflected a conviction after your plea, it is not clear what will show for Canada and when it will be updated to reflect the dismissal. You may want to have a certified copy of the dismissal and keep it with your papers if you go to Canada so that if a question is raised, you have the paper to show the dismissal.
