Probably since you did not learn better from the first time. Give this up since you are incompetent as a thief.

Instead of worrying about the jail time, you need to focus your attention on how you can avoid being convicted. Larceny with a prior can be filed as a felony, not to mention is a crime of moral turpitude, and if convicted you can kiss your career aspirations goodbye. Hire a lawyer before you get duped into a plea you will regret for life.

You could, but then again, you might not. Depends on too many factors to say for sure. You should consult with a local criminal defense attorney to get a better idea. Hiring an attorney would be a smart move.

Without aggravating facts in California second time petty theft is not a charge that results in jail time.

It depends on the judge and what the prosecutor will be asking for. With each subsequent conviction, especially less than one year apart, the possibility for jail only increases. Consult with an experienced criminal defense attorney in your area to discuss your case and get a better idea of what to expect and what your options are.
