QUESTION

Will my friend remain in custody or be placed in a program?

Asked on Apr 30th, 2013 on Criminal Law - Georgia
More details to this question:
I have a friend that has been put in custody for about a week now for a violation of parole. The reason for the violation was curfew and he caught a new case and today is his hearing. The good thing is that he completed all his programs. He never had bad urine and this is his first violation.

It will be up to the court, normally a probation violation results in serving the time. He needs an attorney.

Whether he will remain in custody or be released, should be in the discretion of the judge. He will need an advocate to argue for his release, so I strongly suggest that you hire an attorney to represent him at any trial or hearing.

You do not say what he is on parole for. You do not say what the new charge is. You do not say anything about his criminal history. If he has been in jail for a week, I suspect that the violation is substantial. Such being the case, I have no idea. It is ultimately up top the judge.
