Will my record show my Class 3 Felony?

More details to this question:
I have a class 3 felony. What rights can I restore, and will I ever be able to be a nurse? Will my record show up? Will my backround show when applying for an apartment or a job, in government, after my rights are restored?

I assume this felony was not in California. If you are not in prison, you can vote in California. Not sure if you can own firearms if it was an out of state conviction. (All California felonies prohibit firearms possession for life). Yes, this will likely pop up in a background check.

Every arrest, charge and conviction "shows" on your record, forever, to anyone checking it. That is the whole purpose and meaning of "record". The effect on you is up to them. However, some CA convictions can be 'expunged' from criminal records by proper application and Petition to the court, but ONLY IF there was no felony prison time sentenced whether served or not, and if it was not for certain listed sexual crimes, and if all terms of sentencing and at least one year of probation are completed, and if there are no new charges pending. Sounds like yours may qualify. If successful, the conviction would be withdrawn and the charges dismissed. Expungement does NOT "clear", 'remove', "erase" or "disappear" the conviction, but does change the record to show an arrest with 'conviction reversed and charges dismissed by expungement'. The conviction is still a 'prior' or 'strike' for purposes of repeat offenses. Expungement does not restore firearm rights lost because of felony conviction or domestic violence restraining orders. That record is accessible to government agencies, law enforcement, courts, background checks, insurance companies, etc. Expungement will help in obtaining employment. When applying for a job in the private sector, in response to any question concerning your prior criminal record, you may ?legally? deny that you were arrested or convicted of the offense. However, you must disclose the arrest and conviction in any questionnaire or application for certification or licensing by any government agency [medical, legal, educational, professional, law enforcement, security clearances, bonding, etc], for public office, for a position as a peace officer, for contracting with the California State Lottery, or for purposes of serving on a jury. The licensing agency then will decide whether the nature of the past convictions and your record will bar you from licensing and employment in that field.

A class 3 felony is not a term used in California law. I don't know the law in other states. You may be able to become a nurse it depends what the conviction was for and how long ago it occurred.

Michigan does have clasees of felonies. In Michigan. even if the offense is expunged. it still will be available if you try and get a nursing license.

Make sure you file an expungement. In most cases, a regular background check will not find your conviction.

Your record will show the Felony. Generally, your rights to vote and to carry a firearm are lost if convicted of a Felony. If a background check is conducted, yes your Felony will show up. You can proceed to petition the court to get the rights back. You can also petition to have your record expunged.

If you have a felony, yes, it will show on your record. You may or may not be able to have it removed (depends upon the charge and how old it is). Upon being convicted of a felony, you lost certain constitutional rights. You need to petition the court to get them back.

Felonies come in four flavors: class A, class B, class C, and unranked. There is no class 3. All but class A can be expunged after varying periods of time. Your ability to be a nurse depends on the nature of your felony.

Depending on what kind of sentence you served, ex, straight probation, a expungement of the felony is possible through post-conviction dismissal. The great thing about this is that the conviction comes completely off your record and all of your rights are restored, as if the felony conviction never happened. No employer will know about the felony or be able to take that into account when hiring, firing or promoting. If you served a state prison sentence, dismissal is still available through either a certificate of rehabilitation or pardon.

I assume you are referring to a Washington State Class C felonyand depending on some other information not included in your question you may be able to vacate that conviction. I am fairly confident, however, the conviction will show up on a background check.

If it's been over five (5) years AND you have no other crimes . . . you can get it expunged, UNLESS sexual crime, drinking/driving offenses. It'll cost you around $500-600.

You are a convicted felon and it will be on your record forever. I don't know about nursing licenses. It will always show up. No way to hide it.
