I was given a citation for shoplifting (not taken to jail but arrested) 1st offense with no criminal record. WalMart violated some of their key rules regarding shoplifting. 1. I was manhandled as a female, which resulted in bruising & another injury of a hand I recently had surgery on. I DID NOT resist arrest. (brusing on arms, photos) 2. They did not identify themselves, only walked up & grab me. Both in solid black clothing. 3. Denied my request for restroom & medical after the stitches in my hand were ruptured, causing bleeding. 4. I wasn't fully past the point of sale, no items were concealed, they were in open walmart bags. On cameras you could see the buggies a few footsteps from the door. I was trying to grab one to help ease the burden because I only had one good hand. 5. I asked for an Attorney & phone call, which was denied. They refused to view the text messages sent to a family member in the store just minutes before, which proved lack of intent to shoplift.
You need to contact a local lawyer in SC to sort this out with you. Without a record, you may beable to get out of this with no record. If you want to fight it on all these issues, you need to gear up with an attorney, have him get the video and be prepared for a jury trial down the road.
