A drunk driver hit my parked car outside my place and leave the scene. His car was damaged and he tried to fix it for 10 min in front of several witness before the police arrived . The officer on the scene did not file a report because apparently he knew the guy ,(He gave me a receipt that I kept of this "missing report") The officer did not take the name of the witness and their information , I had to provide on the witness to my insurance But there are at least 5 witnesses living within 500 yards of the accident that maybe a lawyer or myself can contact. My insurance cannot therefore access the police report. There has been for 7500 dollars of damages and my deductible is at 500 . They contacted the owner of the car hitting me and they said that the car was stolen but no police report was filed . If the police report has been filed about my accident we would have paid only $200. Can I sue the driver and get the $500 plus an extra for the stress and hassle? Thank you
Sounds like really bad police work. I am not sure of the motor vehicle laws in WA but it sounds like you dont have insurance or really minimal insurance. Yes, you can sue the other driver for damages and expenses but not pain and suffering.
