QUESTION

Any possible consequences for a marijuana DUI?

Asked on Jul 20th, 2013 on DUI/DWI - Michigan
More details to this question:
I am 18, and this is my first offense on my record. I was pulled over and arrested for DUI of marijuana. I was also in possession of about .7 grams of marijuana. My charges were DUI driving a vehicle and DUI Drugs. After making it to the station in cuffs, blood was drawn providing evidence that may possibly be used against me. I am in the process of looking for a car to make payments on. Will my license be suspended thus preventing me from operating a vehicle? If so, what else might the consequences be?

The consequences are a criminal record, fines, suspension of your license, higher insurance rates, attorneys fees, possible jail. This is the same for drunk driving.

Yes. They are the same as an alcohol DUI. The only difference is the DMV will not hold its own hearing to suspend your license. The license will only be suspended if you are convicted of DUI. Whether someone is under the influence of marijuana so as to impair their ability to drive to the extent that is required under the law is difficult to prove. It is also scientific in nature. The defense of a marijuana or other drug DUI requires coordination with a toxicologist and police practices expert.

In Missouri, if your license is revoked or suspended, you can get a hardship license to drive to and from work. If it is you first offense, you may get a suspended sentence and probation.

You may be suspended for 3 months for either the Poss of MJ or the DUI depends on the level of MJ in blood - when you get the result, I can help you interpret it why stopped? These cases can be won or even plead to a charge that does not cause these problems.

You are in deep trouble and in need of an attorney. There is a very high probability you will be losing your driving privileges for some time, as well as the fact that if you are found guilty as charged you will have a drug charge on your criminal and driver's record and insurance for a car may become prohibitively expensive, if available at all.
