Assault on a peace officer

More details to this question:
My husband was arrested from ICU at a hospital. He had just gotten off of life support ( ventilator) and seditives to keep him unconscious the day before. He was status epileptic and that is why he was there. He was very agitated and they said he hit a security officer. Now they are charging him with assault on a peace officer. I just think it wasn't his fault he didn't know what was going on. What should I do?

You could hire an attorney. Assault on a peace officer is a third degree felony. If convicted it is 2 to 10 years in prison and a fine up to $10,000. If he was hospitalized around when the time it happened, he may have a defense. The intent element can be challeneged if he was medicated or undergoing a medical emergency.   Tristan LeGrande
