QUESTION

Been Placed on Megan’s Law illegally.

Asked on Aug 03rd, 2017 on Sex Crimes - Pennsylvania
More details to this question:
I was convicted of a sex crime in 1988, which I didn't do,Megan’s Law was never a part of my sentences, after I moved to Philly PA. about a month here I get a letter from the ST Police saying I was placed on Megan’s Law retroactively, from that day on my life has been in hell ever since, every thing that has happen to me since then would of never happen if it wasn't for Megan’s Law. In 2011, I had a $35,000 year + job, had money in the bank, was going to buy a house, all shot to hell by the ST Police, some Tropper decided he was going to harass my work, got fired cause of the ST Police. I went to the ST Police in Bensalem and told them to take this Megan’s Law and stick it where the sun don't shin, and I never went back. I need help, I lost every thing I have due to this Megan’s Law, there much more to this story. My life has been placed in Pearl twice, been injured cause of it and much more. I agreed to a 11/1/2 to 23/1/2 sentences but was screwed and got a 2-4.

Megan's law is certainly a tricky subject and the challenge is that it is never a part of negotiations because it is mandatory with certain charges.  There is new Supreme Court law in the Commonwealth of Pennsylvania regarding retroactive application.  You should consult with a local defense attorney, one who does appellate work and see if you can challenge the application of the law.  One of things you have to do is be careful ignoring it.  Failure to register is its own penalty and can carry large sentences in and of its own right.  There are many defense attorneys in the Bensalem and Philadelphia area who are skilled with this kind of case.  Challenging it will be a timely process, one best handled by an experienced attorney.
